Sir,
I have laid before the Lords Commissioners of Hie
Majesty's Treasury Sir C. Walker's letter of the 1st instant
(C.W.16113), relative to the case of Captain Robert A.R.
Neville R.M.l.I., who has been appointed aide-de-camp to
the Governor of Hong Kong.
In reply I am to request you to inform the lords
Commissioners of the admiralty that the Rules made under
Section 6 of the Superannuation Act, 1887, apply with
statutory force in this case, and My Lords have no power
to authorise a departure therefrom.
The question whether Captain Neville's appointment
is an "office of profit" within the meaning of the Rules
is a matter for interpretation. But having regard to the
fact that power is specifically given to the Treasury by
Rule 5 (2) to exempt from the operation of Rule 4 employment
the profite of which are petty, it is impossible for Their
Lordships to accept the view that Captain Neville cannot be
regarded as holding "employment of profit". No power is
given to the Treasury to exempt such cases from the operation
Rule 10.
